Two police officers accused of murdering lawyer Mathew Kyalo Mbobu have been ordered to undergo mental assessment before they can take a plea in the case.
PC Julius Kipkoech Cheruiyot, attached to Pangani Police Station, and PC Kennedy Kipkeméi Borboroi of South B Police Station appeared before Kibera High Court Judge Diana Kavedza on Thursday but did not take a plea. The prosecution requested that the two officers be subjected to a mental assessment before the murder charges are read to them.
Senior Assistant Director of Public Prosecutions Gikui Gichuhi told the court that five suspects are facing murder charges over Mbobu’s death. The charge sheet names Rose Mbithe Mulwa, also known as Rose Mbithe Ndetei; Chris Mulwa; Angela Mulwa; PC Cheruiyot; and PC Borboroi. They are expected to be charged with murder contrary to Section 203 as read with Section 204 of the Penal Code.
It is alleged that the five, jointly murdered Mbobu on September 9, 2025. The offence is said to have occurred at about 5.30pm along Magadi Road near Brookhouse International School in Karen, Nairobi.
The prosecution sought production orders for the three civilian accused persons who are currently in custody. Chris Mulwa is being held at Industrial Area Remand Prison, while Rose Mbithe and her daughter, Angela Mulwa, are being held at Lang’ata Women’s Prison.
The DPP further asked the court to give directions on the appointment of advocates to represent the two police officers.
Judge Kavedza directed that PC Cheruiyot and PC Borboroi be taken to Mbagathi Hospital for mental assessment before being presented for plea. The judge also directed that all five accused persons appear in court for plea on October 27, 2026, after the assessment has been conducted.
