Court Stops Kiambu County from Replacing Doctors Pending Hearing

The Employment and Labour Relations Court has stopped the Kiambu County Government from replacing its doctors pending the hearing and determination of a case filed by the affected medics.

Justice Hellen Wasilwa issued the interim orders on Monday, barring the Kiambu Chief Officer for Health and the County Public Service Board from proceeding with the recruitment process.

“The application is certified urgent and allowed in terms of prayers B and C of the Notice of Motion. This application should be served upon the respondents and be heard inter partes on October 28, 2025,” reads the court order.

The case was filed after the county advertised several vacant positions in the Department of Health, inviting new applicants to fill roles that are currently occupied by existing doctors. The advertisement’s deadline was October 15, 2025.

In their petition, the doctors argue that the county’s actions are unlawful and intended to unfairly replace them, despite their ongoing employment. They claim that the move has “adversely affected and aggrieved” them, amounting to an abuse of their labour rights.

The court has now directed that all parties be served and the matter be heard later this month to determine whether the recruitment process should be permanently halted.
