Court throws out case of man who wanted compensation after condom broke during intercourse

A man who wanted a condom company to pay his damages for selling him a faulty condom that broke during intercourse has lost the case.

The high court on Thursday dismissed the case in which Williamson Omworo wanted compensation after he got an STD due to the condom breaking.

However, Justice Lawrence Mugambi threw out his case ruling that Omworo a serial cheat could not be trusted in his evidence.

Omworo had told court that his wife had left him after he infected her with STD he got after the condom broke said he got stressed due to that.

His wife blamed him for being unfaithful in their relationship and subsequently, they fell apart and his wife left him.

He claimed that he was a victim of substandard condoms which led him to contract a sexually transmitted disease.

Justice Mugambi noted that Omworo could not be trusted as he had several affairs with many women even though he was married.

“This is a man who admits that he is married. That notwithstanding, he says he cheated on his wife with several women (not one), in different towns in various counties. This is a man whose quality of honesty is already shaky,” the court ruled.

Justice Mugambi further wondered whether he could take Omworo’s evidence considering his character.

The court also said Omworo should have brought the woman he slept with when the condom broke to corroborate his story but he did not.

The judge dismissed Omworo’s claims that his consumer rights were violated saying he could not even prove that he ever bought the said condom or ever used it.

He had sued the distributors of Zoom Beta Healthcare International, KRA and KEBS.
