The Office of the Director of Public Prosecutions (DPP) has announced plans to oppose former Kiambu Governor Ferdinand Waititu’s application for release as he awaits the hearing of his appeal.

During a court session held on Wednesday, April 30, 2025, Assistant Director of Public Prosecutions Vincent Monda informed the judge that the prosecution would be filing additional submissions to contest Waititu’s petition.

Court news reports that this development comes after the court granted permission to Waititu’s legal team to amend his appeal in the ongoing KSh 588 million corruption case.

Waititu and his wife, Susan Wangari, were previously found guilty of conflict of interest and involvement in questionable property transactions. The court ruled that the two were part of a scheme that embezzled millions from Kiambu County through a fraudulent multi-million shilling road tender. Waititu was sentenced to either pay a KSh 53.5 million fine or serve a 12-year prison term.

In recently filed documents with the Anti-Corruption High Court, Waititu argues there is no direct evidence linking him or his companies to the awarding of the tender to Testimony Enterprises Ltd. He also claims that the trial magistrate, Thomas Nzyoki, wrongly concluded that funds found in the accounts of Mbuthia and Testimony were proceeds of corruption.

Another key figure in the case, Charles Chege, who was convicted alongside his wife Beth Wagechi Mburu for procurement fraud, has also filed an appeal. The couple was fined a total of KSh 297.5 million or, in default, sentenced to 11 years in prison.
