Firm that challenged Mumias lease withdraws case days after President Ruto’s remarks on being sent to heaven

One of the firms that had challenged the Mumias Sugar Company lease issued to Ugandan sugar Miller Sarrai Group has now withdrawn its case.

This comes days after President William Ruto issued ultimatum to those who were opposed to the lease to revive Kenya power.

In a notice of withdrawal, Vertox Limited says it’s seeking to leave the case challenging the appointment of Ramana Rao as Mumias receiver manager and Sarrai’s lease.

“Take notice that Vartox Resources Inc., the 3rd Respondent in these proceedings hereby wholly withdraws its application dated 25 December 2022,” the notice reads.

“I have told all those people to get out. That company is a public company and we will reorganize it. If they make me angry, there are three things, either leave Kenya, end up in jail or go to heaven,” the president said

In April last year, the court canceled the lease issued to Sarrai Group to revive the sugar company.

Sarrai was ordered to immediately vacate the premises of Mumias Sugar.

The Ugandan company had already began works and even pumped money into reviving the collapsed sugar mill but the court stopped the process after several bidders challenge the bid.

They moved to the court of appeal which suspended the high court decision and allowed them to continue operations.

Several creditors had filed cases challenging the lease but Vertox is the only one which has withdrawn.
