Kithuka Kimunyi Musyimi, the man accused of killing a police officer attached to State House, will remain in police custody pending the hearing and determination of his murder case.

This follows a ruling by High Court Judge Justice Diana Kavedza, who found that the prosecution had established sufficient grounds to deny the suspect bond.

In her ruling, Justice Kavedza stated that although courts must exercise caution to avoid speculative reasoning when determining bail applications, cases involving credible threats to national security and the safety of officers protecting the President require a stricter risk assessment.

“In such circumstances, the likelihood of interference with witnesses and recurrence of similar conduct cannot be lightly dismissed,” ruled Justice Kavedza.

The judge further observed that where the safety of the State and its protected institutions is implicated, the court is entitled to give significant weight to public interest considerations.

Musyimi is facing murder charges over the death of General Service Unit (GSU) officer Ramadhan Khamisi Matanka, who was on duty at State House, Nairobi. The said murder occurred on the morning of October 10, 2025, at State House Gate D along Dennis Pritt Road.

The preliminary investigations alleges that Musyimi approached the gate disguised as a street dweller while carrying a blue sack containing a bow and arrows. He allegedly attacked and shot Constable Matanka in the chest using an arrow. The officer was rushed to Kenyatta National Hospital for emergency treatment but later succumbed to his injuries.

Following investigations and a mental assessment, Musyimi was arraigned before the High Court in Kibera in April 2026, where he pleaded not guilty to the murder charge.

Justice Kavedza directed that the accused person remain in custody until the case is heard and determined. The matter is scheduled for hearing on July 27, 2026.
