The High court has deferred the delivery of judgment in a case seeking to halt the proposed sale of Safaricom shares, citing the need for more time to scrutinize voluminous documents filed by the parties. The bench said it had worked extensively, including into the late hours of the night, during the period allocated for preparing the judgment. However, the large volume of documents presented in the case required meticulous scrutiny and consideration before the court could determine all the issues raised.
The court apologized for being unable to finalize the judgment within the initially allocated period and sought the parties’ indulgence to allow the bench additional time to prepare a comprehensive determination. The judgment has now been scheduled for September 15, 2026.
Justice Francis Gikonyo said the decision to seek additional time was also informed by the principle of judicial accountability under the Constitution, noting that the extra time would enable the bench to address each of the issues raised by the parties.
Kalonzo Musyoka welcomed the decision, saying the parties had no objection to the new date. He, however, emphasized the national significance of the matter, noting that the country was waiting for the court’s decision. Justice Francis Gikonyo said that the judgement will be delivered on 15th September 2026 virtually at 11am.
