Kalif Kairo Settles Sh5.9M Fraud Cases Out of Court

Two fraud cases amounting to Sh5.9 million against Nairobi businessman Joseph Kairo Wambui, popularly known as Kalif Kairo, have been formally withdrawn after an out-of-court settlement was reached.

The cases were terminated on Monday before Milimani Chief Magistrate Lucas Onyina when the complainants, through their lawyer, confirmed that they had received full reimbursement from Kairo.

Kairo’s defence team informed the court that their client had settled the claims and the complainants were no longer interested in pursuing the matters. Acting on this confirmation, Magistrate Onyina ordered the withdrawal of the charges under Section 204 of the Penal Code, which allows criminal proceedings to be discontinued where parties agree to resolve the dispute amicably.

One of the withdrawn cases involved a claim by Dona Ayalo Okoth, who alleged she was defrauded of Sh2.98 million by Kairo’s company, Kai & Karo Limited, under the pretext of importing a Subaru Outback between July and November 2024. Despite making payment into the company’s KCB account, the vehicle was never delivered.

In the second case, Jeff Kyule Munane accused Kairo of obtaining Sh2.15 million in a similar importation scheme. The money was meant to facilitate the purchase of a Honda Vezel Hybrid from Japan, but the car was not supplied.

Kairo had pleaded not guilty when the charges were first filed, but the refund has now led to the withdrawal of both matters.

Even as the two cases come to a close, the court was informed that a third fraud case against Kairo remains pending, with talks between the parties still underway. That case is expected to come up for mention in December.
