Kakamega Senator Boni Khalwale has threatened to sue local businessman Cleophas Shimanyula alias Toto for over Sh 200 million in damages if he does not apologise for slandering his name.
Khalwale claims that Toto has been spreading news and information that he was the one who killed his worker Kizito Amukune and not the bull and the senator had told police.
Through his lawyer Danstan Omari, Khalwale has written a demand letter and served it upon Toto who has 48 hours from today to apologise or be taken to court for defamation.
In the letter, Omari says Toto has been making scandalous, defamatory, false, baseless, and unfounded claims” on social media, contesting the police findings in the death of his worker who was killed by one of his bulls.
Omari says the businessman has been profiling the senator as a “murderer” and portraying his wives as “prostitutes” in a video that went viral.
He said that the video puts Amukune’s death into question, implying that he was stabbed by the lawmaker rather than suffering injuries from the bull assault.
Omari says so far there have been two post-morterms conducted with one where Toto’s pathologist was there to represent him and all have vindicated the senator so it’s only right that he apologises for maligning his name.
Khalwale has also denied influencing the police in their report on his employee’s death, stating that he will use all available approaches including legal action, to discredit erroneous reports that have caused serious personal and business injury.
While addressing the media at the Milimani Law Courts Omari was accompanied by Khalwale, lawyers Shadrack Wambui and Brian Mabea who are also part of the legal team for the legislator.
