The Law Society of Kenya (LSK) has challenged last week’s decision by the Supreme Court to ban lawyer Ahmednasir Abdullahi from the court.
In a petition filed in court, LSK argues that the decision to ban Ahmednasir and his entire law firm is unconstitutional and unreasonable.
In the case filed under a certificate of urgency, LSK argues that Ahmednasir together with his employees were never given an opportunity to be heard.
Through Lawyer James Gitau, LSK says the court did not consider the harm that would be caused to the lawyer and his employees as well as his clients.
“A democratic country requires pluralism, tolerance and broadminded which respectfully, the Supreme Court has failed to exercise,” reads court papers.
LSK wants the high court to quash the decision made by the Supreme court to ban Ahmednasir.
LSK claims that also in 1990 and early 2000s, at a time when corruption and incompetence were again said to be rife within the Judiciary, it was Ahmednasir who almost singlehandedly took onto the task of naming and shaming the judges, resulting in the dismissal of 23 judges.
LSK further argues that the decision by the apex court contravenes the rights of any advocate of the high court who would want to join Ahmednasir’s firm to practice law.
