The owners cosmetic clinic Body by design and a doctor were on Wednesday charged with the death of Lucy Wambui who died after undergoing liposuction at their facility.
Lilian Wanjiru and George Wakaria Njoroge were charged alongside surgeon Robert Maweu Mutula for the death of Wambui.
Omnicare Medical Limited alias Body by Design Kenya was also charged as a facility.
They denied manslaughter charges in connection with Lucy’s death that occurred on October 6, 2024 allegedly after undergoing a procedure at the said facility.
They denied the charge before Kibera Senior Principal Magistrate Samson Temu.
The Prosecution strongly opposed their release on bail and bond arguing that they may interfere with witnesses.
However, the defence lawyers lead by Advocate Danstan Omari, Cliff Ombeta, Sam Nyaberi and Shadrack Wambui objected to the said application to deny the accused persons bond saying that right to presumption of innocence is enshrined in the constitution and that the said right cannot be limited without a tangible evidence that the suspects were flight risks and they would interfere with the investigations or any witness.
They urged the court to release the suspects on reasonable bail and bond terms.
The court will tomorrow make a ruling on whether it will release the three on bond
