President William Ruto has formally requested the court to remove his name from one of the petitions related to Deputy President Rigathi Gachagua’s impeachment proceedings.
In a preliminary objection filed through his lawyer, Adrian Kamotho, President Ruto argued that he cannot be sued in his personal capacity while serving as head of state. He further contended that the court lacks the jurisdiction to hear the petition, describing it as an abuse of the judicial process.
Ruto’s legal team emphasized that, according to the Constitution of Kenya 2010, civil proceedings cannot be instituted against a sitting president or any individual performing presidential duties during their tenure.
“The petition has been filed in clear disregard of the law, and is an abuse of court process. It cannot be entertained or determined by this honorable court,” stated the court documents.
In the petition, President Ruto is listed as the fifth respondent, while the embattled Deputy President Gachagua is named as an interested party. The President is now asking the court to dismiss the case and remove his involvement in the proceedings entirely.
The impeachment trial against DP Gachagua has drawn national attention, and the legal proceedings are being closely monitored as both parties present their cases.
