The prosecution has strongly opposed the release of Sarah Wairimu Cohen on bail saying if granted bail she may interfere with witnesses set to testify against her.
Sarah was charged last week with the murder of her late husband Tob Cohen whose body was found in a septic tank in his home in 2019.
The prosecution asked court to deny her bail saying that there are two key witnesses that need to testify before she is released on bail.
State Counsel Vincent Monda told court that it will be prejudicial to release her on bail.
“At this stage it will prejudicial,the two protected witnesses at the appropriate moment we will be asking the court that they take their testimony in camera,” Monda says
On witness interference, Monda submitted that some of the witnesses claim that they were allegedly told to lie.
It will be prejudicial for the accused person to be released before two key witnesses testify,the prosecution says it’s ready to avail the two witnesses to testify as soon as possible and thereafter the accused person can renew her application for bail
The court heard that if released on bail she is likely to interfere with the witnesses
On witness interference, prosecution says that some of the witnesses claim that they were told to lie
“She is actively interfering with potential evidence that will be furnished to this court by dint of her reading inthe home owned by the victim , where the victim body was found,” he said
