Businessman Jimmy Wanjigi on Tuesday obtained court orders shielding him from any further arrests and prosecution related to his firearms, pending the hearing and determination of a case he filed. The High Court temporarily barred the State from initiating or continuing any criminal charges against Wanjigi regarding his firearms and accessories.
Wanjigi, through his legal team, challenged his recent arrest, arguing that it was unlawful and amounted to an abuse of the court process. His lawyers claimed that the police had disregarded a valid court order that had previously halted his arrest.
Justice Bahati Mwamuye granted Wanjigi temporary relief, issuing a stay on the prosecution until the case could be heard in full. The case is scheduled for mention on September 19.
Prior to this ruling, Wanjigi had appeared before a Nairobi court to face charges of possessing firearms without a license. His defense team, led by prominent lawyers Paul Muite, John Khaminwa, and Willis Otieno, successfully requested an adjournment of the plea, citing the existence of a valid order prohibiting his arrest.
Despite the legal wrangling, Milimani Chief Magistrate Susan Shitubi granted Wanjigi a personal bond of Ksh 10 million and ordered him to surrender his passport to the court. These measures were put in place shortly before the High Court’s decision to halt his prosecution.
For now, Wanjigi has secured a reprieve, with the court orders preventing any further legal action against him until the matter is fully resolved.
