A Media Commercial Director who was charged with threatening to kill her estranged lover has now challenged her prosecution at the high court.

In the case, Farida Idris Mohammed has argued that her prosecution was in bad faith and was a way for her former lover Hussein Amaro to punish her.

Mohammed was accused of sending threatening messages to Amaro in 2019 when they had a fall out.

Some of the alleged messages she allegedly sent are “Now tell me what … you will do to me and you see I will finish you …
Another message reads “…. if I get that Swarma … she will know who I am ….”

In court papers, she claims that she was in a romantic relationship with Amaro and they lived together as a couple for nine years.

Mohammed has told court that they even incorporated a company called Enersence Solutions Limited where they were the Directors’ shareholders, each holding 50%of the shares.

However, in 2019 they parted ways in a nasty manner and since then they have been embroiled in civil disputes and frivolous complaints to the DCI over the ownership of the company.

She claims that the reason for her prosecution was because they could not agree on ownership so Amaro used his links to arrest her.

”The criminal proceedings are in bad faith and are clearly an afterthought to hit back and express vendetta against the petitioner following their acrimonious relationship fallout and failure to settle 17 million shillings within the timeframe as demanded by the ex-lover,” she claims.

She further argues that the DPP failed to conduct clear and unbiased assessments of facts to substantiate the charges against her .

It is her claims that the decision to charge her amounts to an abuse of court process.

“The criminal case is being used to wield state power over the petitioner as a means of vexation and oppression for ulterior purposes and not as an avenue to litigate a genuine complaint or achieve any justice,” reads court papers.

She wants the court set aside the decision by the DPP to charge and prosecute her saying their case is civil not criminal
