Kibera court orders investigations into government pathologist Dr Ndegwa’s conduct over his negligence in the post-mortem report in a Langata ‘suicide’ case.

A Kibera court has recommended for investigations to be opened against government pathologist Dr Peter Muriuki Ndegwa for his negligence in the post-mortem of a Langata woman who he ruled died by suicide.

In the inquest, Ndegwa was the pathologist who conducted the post-mortem on the late Vanita Nikesh was found hanging in her bedroom in Langata and his report confirmed the same.

However, the court has since ruled that her death was not suicide as Ndegwa had claimed but was murder further finding her husband Nikesh Senghani and his mother liable for her death.

Magistrate Elector Riany ruled that there was a lot cover up and foul play in Vanita’s murder and Ndegwa inconclusive report didn’t help much.

“Investigations be opened against doctor Peter Muriuki Ndegwa over his negligence,” the court ruled.

She noted that Ndegwa performed the post-mortem on April 4 2022 at 11 am and was followed by her cremation on the same day.

The court said as a result in his examination he formed the opinion that her cause of death was death by hanging.

“By the time there was an uproar the deceased body had already been cremated this means that an order for exhumation and another autopsy to be carried out was not issued,” the court noted.

As a result, the opinion of Dr. Johansen Oduor the chief government pathologist was sought and, in his report, he said there was glaring inconsistencies in Ndegwa’s report.

The court said some of Ndegwa’ statements did not make sense and he left them hanging and incomplete.
She noted that Ndegwa denied seeing any marks on the deceased face this was hours after her death he was even shown pictures of the deceased body in court but he denied.

“It was thus questionable why the same pathologist who conducted post mortem on the deceased body would deny the obvious, the same clouded his integrity,” the magistrate ruled.

She also wondered why Ndegwa who is an experienced pathologist would have an incomplete post-mortem ruling that this amounted to negligence.
