A 32-year-old man has denied charges of defiling an 11-year-old boy in Mombasa County. Nabil Farid Swaleh appeared before Senior Resident Magistrate Gladys Olimo, where he was charged with defilement under Section 8(1), read with Section 8(3) of the Sexual Offences Act.
The prosecution alleged that Swaleh committed the offence on October 21, 2026, in the Kizingo area of Mvita Sub-County.
He also faces an alternative charge of committing an indecent act with a child, contrary to Section 11(1) of the Sexual Offences Act. The prosecution alleges that he unlawfully touched the child’s private parts on the same date and at the same location.
Swaleh denied both charges.
Following his plea, Assistant Director of Public Prosecutions Brenda Ogada opposed his release on bond and asked the court to order a pre-bail report before determining the application. Ogada told the court that there was significant public anger directed at the accused and urged the magistrate to consider the seriousness of the allegations and the safety of the minor.
Magistrate Olimo ordered that Swaleh remain in police custody pending the determination of his bond application.
The court is expected to rule on the application on October 26, 2026.
