A Mavoko Court has ordered the release of lawyer Angela Mulwa after rejecting a prosecution application seeking to detain her for an additional seven days as the Director of Public Prosecutions considers whether to charge her over an alleged stolen vehicle linked to the murder of Dr Victoria Mutiso.
The prosecution had asked for more time to hold Mulwa, arguing that investigations had been completed but the Office of the DPP was yet to communicate its decision on whether she should be charged.
Mulwa’s lawyers, Danstan Omari and Cliff Ombeta, opposed the application, arguing that investigators had already indicated that there were no further investigations to be conducted.
In its ruling, the court said the decision on whether to charge Mulwa rests with the DPP and that it would not interfere with the prosecutorial mandate.
However, the court found that the prosecution had failed to provide sufficient reasons to justify keeping Mulwa in custody for an additional seven days, noting that custodial orders are intended to facilitate legitimate investigations.
The court consequently declined the application and vacated the custodial orders against Mulwa.
She was released on a KSh1 million bond and ordered to deposit her passport with the court. She was also barred from leaving the court’s jurisdiction without permission.
Mulwa has further been directed to report to the investigating officer at Mavoko whenever required or until further orders of the court. Lawyer Omari made an application to court to release Angela on a cashbail of which the prosecution and the investigation officer objected.
The court will give its ruling tomorrow 20th August, 2026 whether Angela will be released on a cashbail.
