A 65-year-old man has been sentenced to 20 years in prison after a Kisumu court found him guilty of defiling a 12-year-old child.

Kombewa Magistrate Jocelyn R. Kimmetto convicted the man under Section 8(1) as read with Section 8(3) of the Sexual Offences Act. The prosecution, led by Principal Prosecution Counsel Carolyn Kiptum, told the court that the offence occurred in March 2025 in Seme Sub-County, Kisumu County.

The court heard that the man lured the child to his house at about 4pm as she was returning home from school, where the sexual offence allegedly occurred. The accused denied the allegations and gave an unsworn statement in his defence. He had also faced an alternative charge of committing an indecent act with a child under Section 11(1) of the Sexual Offences Act.

The prosecution presented five witnesses in support of its case, including evidence from a medical examination which was found to be consistent with the allegations.

In her judgment, Magistrate Kimmetto rejected the accused’s claim that he had been framed, describing the defence as unconvincing when weighed against the evidence presented by the prosecution. The court concluded that the prosecution had proved the case beyond reasonable doubt and convicted the man on the main charge of defilement.

He was subsequently sentenced to 20 years in prison.
