There was an emotional moment in court when a man who was found guilty of acquiring an uncustomed Landcruiser broke down weeping and begging the court not to send him to jail.
With tears flowing from his eyes a distraught Gibson Nyabera who was first charged in 2017 and has been in custody since then pleaded with the court not to give him custodial sentence.
Nyabera told Magistrate Benmark Ekhubi that since his arrest and prosecution he has never seen his children and even his marriage collapsed as a result of it.
He pleaded for a second chance saying that seven years he has been in remand are enough to teach him a lesson.
“During the seven years, your honour my business collapsed, my marriage collapsed, I have not seen my kids for all those years after the case started. Even if it is a lesson, I can tell you for free I have learnt it. I pray that you give me a second chance in life at least to be able to save my kids,” Nyabera said.
He told court that he needs a second chance in life so that he can be able to take care of all the siblings his mother left when she died.
Nyabera was charged in 2017 with the offence of acquiring uncustomed goods where it was alleged that he acquired uncustomed used Toyota Land Cruiser motor vehicle with a duty amounting to Sh 642,000.
The court found him guilty and ruled that it was satisfied that the prosecution had proved their case against the accused beyond reasonable doubt.
