Oparanya Threatens to Sue EACC Over CS Nomination Objection.

Former Governor Wycliffe Oparanya has threatened to sue the Ethics and Anti-Corruption Commission (EACC) commissioners and CEO for advising parliament against his suitability for the Cabinet Secretary (CS) position.

Oparanya was nominated as Cabinet Secretary for Co-operatives and Micro, Small and
Medium Enterprises Development by President William Ruto but EACC has written to parliament saying he should not be given the job.

In a letter to EACC, Oparanya through lawyer Danstan Omari says there is definitely malice in the EACC position since he has not been charged in any court for corruption.

EACC claimed to have conducted investigations on alleged acts of corruption against Oparanya and consequently submitted a report to the Director of Public Prosecutions recommending his prosecution.

However, Omari says that EACC selectively failed to disclose the operation of, and the legal/ constitutional implications that the DPP delivered to the EACC a withdrawing their decision of December 18 2023 that had granted EACC consent to charge their client.

“Your letter to the Clerk of the National Assembly referenced above cannot be interpreted as a finding of guilt of our client on your allegations. What remains as a net deduction thereof si a blatant demonstration of your abuse of office in maliciously targeting our client for ulterior motives,” Omari says.

Omari further says they have instructions to demand the immediate retraction of the letter by EACC to the Clerk of the National Assembly dated immediately with the same publicity and notoriety.

“Further, that you cease and desist from harassing our client with unsubstantiated threats of charging him for corruption ni a bid to stop him from offering his services to the people of Kenya without fear or favour,” the letter states.

Omari says failure to heed ot their demands, they have strict instructions to institute proceedings against EACC jointly and severally as individuals exercising personal interests to the detriment of respect of the rule of law and that of the constitution of Kenya.
