A court has recommended that three police officers face murder charges over the fatal shooting of four people during the 2022 Masimba protest, ruling that the victims died from gunshot wounds and that the officers’ testimony lacked credibility.
In its findings delivered on November 12, 2025, the court said ballistic and postmortem reports conclusively showed the four victims were killed by bullets, contradicting the police version of events. It found that the explanations given by the officers were inconsistent and appeared to have been tailored to shield those responsible.
The court directed that Police Constables Hosea, Adam, and Wambua be charged with the offence of murder, saying there was sufficient evidence linking them to the deaths. It also recommended that several General Service Unit (GSU) officers involved in the operation be charged with excessive use of a firearm, conspiracy to defeat justice, conspiracy to commit murder, conspiracy to commit a felony, and being accessories after the fact.
The court noted that the conduct of the officers during and after the shootings pointed to a coordinated attempt to conceal the truth and obstruct justice. It further ordered that the investigation file be forwarded to the Office of the Director of Public Prosecutions (ODPP) for further action.
The inquest stemmed from the deaths of four residents of Masimba in Kajiado County who were shot during a 2022 protest that drew nationwide condemnation and sparked renewed calls for police accountability. The ruling is now expected to pave the way for criminal proceedings against the implicated officers
