A Nyamira man has been sentenced to 15 years in prison for killing his wife following a High Court conviction secured by the Director of Public Prosecutions (DPP). Lawrence Gesore Sagero was found guilty of murdering Nancy Mongina, whom he killed on April 18, 2024, in Borioba Village, Borangi Location, Nyamira North Sub-County.
Nyamira High Court Judge T. Cherere convicted Sagero of murder under Section 203, read together with Section 204 of the Penal Code, after finding that the prosecution had proved its case beyond reasonable doubt.
During the trial, Sagero denied the charge, forcing the prosecution to present evidence to establish his responsibility for the killing. The case was led by Deputy Director of Public Prosecutions Joel Kibet Chirchir, who called six witnesses.
Medical evidence presented in court showed that Mongina suffered fatal head injuries caused by blunt force trauma. The doctor who conducted the post-mortem examination told the court that the injuries led to cardiovascular arrest. The examination further revealed that the deceased had sustained multiple blows to the head, leaving her with a fractured skull and extensive bleeding in the brain.
After considering the evidence, the court determined that the nature and extent of the injuries demonstrated malice aforethought, a key element in establishing the offence of murder. In arriving at the sentence, Justice Cherere weighed the seriousness of the crime against the mitigating factors presented on behalf of the convict.
The judge observed that although the circumstances of the offence called for a substantial prison term, the mitigation warranted a sentence below the maximum penalty provided by law. Sagero was consequently sentenced to 15 years in prison.
The convict has 14 days to appeal the sentence.
