Court orders police to break in Muthaiga multimillion house and rescue woman whose billionaire husband had confined in servants’ quarters for days.

A Nairobi court has ordered the OCS Muthaiga Police Station to break into Multimillion mansion and rescue a woman whose husband has confined in servant’s quarters for days.

Magistrate G.M. Gitonga on Friday issued the orders after the woman moved to court through her family saying her husband had locked the main house and she was stranded in the SQ.

Through her lawyer Danstan Omari, the woman Scholastica Kimani claims that her husband Shakir Merali had changed locks so she was sleeping on the stairs leading to the SQ.

In his ruling, Magistrate has ordered the OCS to enter Muthaiga 426 close and rescue Kimani.

“An order directing the OCS nearest police station to enter the Muthaiga 426 Kiambu close residence, rescue the Applicant and ensure that she has the access and possession of the Muthaiga residence,” the order reads.

The court has also temporarily prohibited Merali or his agents from harassing or abusing Kimani, her family and her children.

Kimani has also been allowed to continue occupying the house in Muthaiga pending hearing and determination of the case.

According to court records, the two who are both billionaires in their own right with adult children studying overseas are embroiled in a bitter divorce case.

In the papers, Omari claims that his client had travelled to the UK to take one of their kids to school and on coming back she found the house locked and locks changed.

There was no one in the compound including her husband so she jumped through the back wall and upon gaining entrance she found only the SQ accessible.

She entered and has been there for days and even her relatives have tried accessing her to no avail.

“The Applicant has been locked within the compound of the Muthaiga house, which is their matrimonial home, but cannot access the house itself,” Omari says.

He claims that Merali has without color of right given express orders that the wife should not be allowed into the house.

“The Applicant has been left all by herself with the security guards, who are working under instructions from the husband, within the compound of the Muthaiga premise,” reads court papers.

Omari says his client is fearful that anything can happen to her while she is all alone in the compound as all the doors as well as the gate have been locked thus there can be no entry into the premises by other persons save the husband.

“Applicant is apprehensive that the Respondent’s actions of leaving her in solidarity are ill-bent to cause her harm and there is imminent risk of loss of life,” reads court papers.

Omari says Merali is a hot-tempered man hence is likely to harm the wife if no intervention is made at the earliest opportune time through the intervention of the police.

The case will be mentioned on October 11 for further directions.
