The high court on Monday suspended the decision by KCAA to stop operations of Pokot South MP David Pkosing’s chopper.

On Friday, the Kenya Civil Aviation Authority had suspended the operations of the helicopter on alleged involvement in banditry and money laundering.

In his ruling, Justice J. Chigiti stayed the decision by KCAA pending hearing of application filed by Pkosing.

” Leave so granted do operate as a stay of the 1st Respondent’s decision to suspend Air Operator Certificate No. 216 and Operations Specifications vide a letter dated 25th August, 2023″reads court order.

Judge Chigiti directed him to serve the respondents with the application and scheduled the matter for mention on October 17.

In the case, Pkosing moved to court through lawyer Danstan Omari challenging the decision to suspend its operations.

Omari claimed that the said decision touches on the source of daily needs not only for the MP and his family but also for the many Kenyans that the business has employed.

Pkosing further claimed that the Aviation was malicious and only wanted to frustrate his efforts to remain in their genuine business.

Omari said his client was never given a right to fair hearing as he was never heard before the decision was reached.

“Applicant had no prior information as to the decision of the 1st Respondent to suspend their Air Operator Certificate No. 216 and Operations Specifications and was not given any opportunities to defend itself in order to avert the suspension,” reads court papers.

According to court papers, the decision to suspend the Air Operator Certificate No. 216 and Operations Specifications immediately was in a bid to frustrate Pkosing’s right to fair administrative action.
