Three men who claim to be the biological fathers of three kids who want a share of late Simeon Nyachae estate now want DNA to confirm that the children are theirs.
The three all claim to have been married to Margaret Chweya who is in court seeking to be recognized as a wife of the late Nyachae.
Chweya says her children Rodney Chweya,John Paul Chweya and Patricia Chweya are all Nyachae’s by blood.
Chweya has maintained that the three children who are all based in the US with her are all Nyachae’s children who she had in Kenya before relocating to the US.
She had asked court for DNA saying that will prove that her claims are true as alleged.
The court advised parties to sit and agree on how the DNA should be conducted.
In a consent filed in court by Nyachae family , they have suggested that the three men and kids also undergo DNA.
They want the three children to give their samples alongside Charles Nyachae as a biological son and two other kids of the late Nyachae to determine if their DNA match.
The three men are Jacob Machuki,George Odero and Michael Pondo.
According to the consent all parties are required to have their representatives present at the harvesting of DNA samples from the children and the other four.
The parties are also supposed suggest at least three of their preferred institution where the DNA will be conducted.
However, Margaret Chweya ‘s Lawyer Danstan Omari is yet to respond to the consent and agree to their terms .
The case is coming up tomorrow for hearing before Justice Eric Ogolla.
