A 36-year-old man from Kisumu has been sentenced to 20 years in prison after a court found him guilty of defiling a 12-year-old girl.
Kombewa Magistrate Court, presided over by Hon. Jocelyn R. Kimetto, convicted Ng’iendo over the incident, which occurred on May 18, 2022, at around noon in Seme Sub-County, Kisumu County.
The prosecution, led by Principal Prosecution Counsel Carolyn Kiptum, charged the accused with defilement under Sections 8(1) and 8(3) of the Sexual Offences Act, with an alternative charge of committing an indecent act with a child.
Ng’iendo denied the charges, prompting the prosecution to call three witnesses to establish its case beyond reasonable doubt. Among those who testified was a clinical officer whose examination findings and recorded history were consistent with defilement.
The court heard that the girl returned home from school around midday on the material day because she was feeling unwell and wanted to seek treatment. She was staying at her aunt’s home, where the accused also lived with his wife and their three children.
According to the evidence presented in court, the girl had settled on a seat in the living room when the accused entered, carried her to a bedroom and sexually assaulted her. The prosecution further told the court that the incident was the fourth time the accused had defiled the minor. He allegedly threatened to kill her if she revealed what had happened.
The girl later disclosed the incident to her aunt, who took her to hospital for examination before reporting the matter to the police.
In his defence, the accused claimed that his wife had framed him. However, Magistrate Kimetto rejected his explanation, finding that it did not undermine the prosecution’s evidence. The court subsequently found him guilty of the main charge of defilement under the Sexual Offences Act and sentenced him to 20 years’ imprisonment.
The convict was granted 14 days to file an appeal against the decision.
