A Mavoko court has granted the State a final seven-day period to decide whether to charge lawyer Angela Mulwa, warning that failure to issue clear directions on whether to prosecute will result in her unconditional discharge and closure of the miscellaneous file.
The court issued the directions after the prosecution requested an additional seven days to obtain directions on whether to proceed with charges arising from investigations in the matter. The prosecution told the court that the file had been forwarded to its headquarters for a decision.
Mulwa’s lawyer, Danstan Omari, told the court that his client had already been released on a KSh1 million cash bail but was immediately arrested and taken before the Milimani Chief Magistrate’s Court in a separate application seeking to detain her for a further 14 days.
Omari said that following the subsequent developments, a murder charge had been preferred against Mulwa and that she was scheduled to appear before Justice Kanyi Kimondo on Thursday at 9am to take plea. He argued that the Mavoko miscellaneous application had therefore lost relevance and urged the court to close the file.
The defence further asked the court to retain the KSh1 million cash bail, saying they intended to rely on the same funds should the High Court grant Mulwa bail in the murder case. The defence also accused the prosecution of abusing the court process by repeatedly seeking extensions to keep the miscellaneous application alive.
The court granted the State a final seven-day period to make a decision. It directed that the matter be mentioned on September 2, 2026, when the prosecution is expected to indicate whether it will proceed with charges. The court warned that if the State fails to provide directions on whether to charge, the respondents will be fully and unconditionally discharged, and the miscellaneous file will be marked as closed.
In the Mavoko case Angela and co-suspect Nelson Masiga were arrested on August 2, 2026, after a Range Rover allegedly belonging to Dr Mutiso was recovered at one of Angela’s properties in Karen. Investigators were also looking into the alleged theft of vehicles belonging to the deceased and alleged forgery of a land title connected to a disputed land in Mlolongo.
