Two men have been sentenced to death after a Moyale court found them guilty of violently robbing four people in an attack in Marsabit County.
Nashon Ochieng Agutu and Jackson Okech Odhiambo were convicted on four separate counts of robbery with violence under Section 295 as read with Section 296(2) of the Penal Code. The convictions followed a full trial at the Moyale Law Courts, where the prosecution called 13 witnesses to prove its case.
Senior Principal Magistrate Willy Cheruiyot found that the evidence presented by the prosecution established the men’s involvement in the robbery and convicted them on all four counts. The case stemmed from an incident on April 23, 2025, in Dabel, Moyale Sub-County. The court heard that Agutu and Odhiambo, together with other accomplices, attacked Alinoor Mamo, Silas Kalunge, Linus Murithi Marinda and Bruno Thomas.
The attackers were armed with dangerous weapons, including firearms, and made away with cash, mobile phones and other personal belongings belonging to the victims. The four victims were also assaulted during the incident and suffered injuries.
Prosecution Counsel Benard Leadi presented evidence from the 13 witnesses during the trial, which the court found sufficient to establish the charges against the two accused. While sentencing the pair, Magistrate Cheruiyot considered the manner in which the robbery was carried out, the injuries inflicted on the victims and the use of lethal weapons during the attack.
The court held that the circumstances of the offence called for a deterrent punishment and sentenced both men to death. Agutu and Odhiambo were given 14 days to challenge both their convictions and sentences through an appeal.
