Omari Demands Apology and Sh5 Million from Nelson Havi for allegedly calling him an ‘idiot’

City Lawyer Danstan Omari has issued a demand letter to Advocate Nelson Havi seeking an immediate retraction, apology and Sh5 million in damages over what he describes as a defamatory post published on X calling him an idiot.

Through the lawyer Shadrack Wambui, Omari accuses Havi of publishing offensive remarks on 27th February 2026 at 5:35 p.m. via his official X account under the username Nelson Havi.

According to the demand letter dated 2nd March 2026, the contested post allegedly referred to Omari as “an idiot” and suggested that a judge should “instruct a serious Advocate to get him out of the hole he is in,” words the letter describes as malicious and injurious to Omari’s professional standing.

The letter states that the publication was widely accessible to the public and was reasonably understood to refer to Omari in his capacity as an advocate and public figure. It argues that the statements portrayed him as incompetent and unprofessional, thereby lowering his reputation in the eyes of right-thinking members of society.

Omari’s lawyers contend that the post has caused him immense embarrassment, distress and reputational damage, which they say continues for as long as the publication remains online and is shared or amplified.

In the demand issued, Havi has been required within 24 hours of receiving the letter to immediately delete the impugned post from X and any other platform where it may have been reproduced.

He is also required to publish a clear and prominent apology and retraction on his X account, in terms to be approved by Omari’s lawyers, and with comparable prominence to the original post.

Additionally, the letter demands payment of Sh 5 M as compensation for the alleged reputational injury, distress and professional harm occasioned by the publication.

The advocates warn that failure to comply within the stipulated 24 hours will result in legal proceedings being instituted against Havi without further reference to him.
