Owner of gas station and three suspended NEMA officials arraigned in court over explosion

The owner of the Embakasi gas station and three suspended NEMA officials were on Tuesday arraigned in court over the explosion that has so far claimed six lives and left hundreds injured.

The state has informed court that the DCI will be Investigating the three suspended NEMA officers and the owner with the offence of murder among other offences.

The NEMA officers Joseph Makau, David Walunya Ong’are, Mirriam Mutete Kioko and the owner Derick Kimathi were arraigned before Nairobi magistrate Dolphina Alego .

Other offenses they face include conspiracy to commit fellony, negligent act causing harm and abuse of office contrary to the Law.

The DCI arraigned them in court and sought for 21 days detention order to allow them conclude investigations.

According to court records, the suspects are said to have committed the said offences on diverse dates between January 1, 2020 and February 2,2024 where through their negligent act, an explosion occurred within the premises of Maxxis Energy Nairobi causing 6 deaths and over 300 people burned and currently nursing critical injuries.

The court was told that most of the Victims are still traumatised and they have not been able to record their statements.

DCI further told Court that identification of the deceased persons has not been established as the postmortem is yet to commence.

According to the DCI report, some of the bodies were burnt beyond physical recognition necessitating DNA analysis which is yet to be done.

The state said that preliminary investigation revealed that the four respondents were directly involved in the fatal explosion.

The policeargue that the four persons have been hiding since the matter was reported and alot of resources have been used to track them down adding that they should not be released on police cash bail.
