The Public Service Commission has asked the court to dismiss a case filed by a lobby group challenging the removal of DPP Renson Igonga saying it’s been bypassed by events.
In an affidavit filed in court, commission’s CEO, Paul Famba,says businessman Hussein Amaro filed the petition but later withdrew it on March 3 thus there is no pending petition for the DPP’s removal.
“For this reason, the substratum of this petition no longer subsists, and there is nothing for this honorable court to determine,” the affidavit states
The commission has also requested the court to mark the case as concluded.
In the case, Businessman Hussein Aila Amaro had accused Ingonga of misconduct over his decision to withdraw a criminal case involving alleged threats to kill him.
The petitioner argued that the DPP’s actions constituted abuse of office and warranted disciplinary action that’s why he wanted the PSC to remove him from office.
However, in the application before the Milimani Law Courts, Sheria Mtaani na Shadrack Wambui defended his decision, asserting that he was acting within his constitutional mandate under Article 157 of the Kenyan Constitution.
