Seven Charged at Milimani Law Courts for Defrauding Social Health Authority of Over KSh2 Million

Seven people, including medical staff and a private health facility based in Mtwapa, Kilifi County, were on Monday charged at the Milimani Law Courts with conspiring to defraud the Social Health Authority (SHA) of more than KSh2 million through falsified medical claims.

The accused Patrick Kimuyu Kanya, Faith Chepkirui Bil, Steven Okinyi Ojwang, Justine Baraka, Pauline Wanjiru, Naida Mbevu, and Jambo Jipya Medical Clinic are facing multiple counts, including conspiracy to commit a felony, forgery, and uttering false documents.

They all denied the charges before Chief Magistrate Lucas Onyina and were released on bond. The first and second accused were each granted KSh600,000 bond or an alternative cash bail of KSh200,000, while the third to sixth accused were released on KSh200,000 bond or KSh70,000 cash bail, each with one surety.

Before taking plea, the defense team argued that the court lacked jurisdiction to hear the case, but the magistrate ruled that the Milimani Law Courts were properly seized of the matter.

According to the prosecution, between November 1, 2024, and June 30, 2025, the accused conspired to falsify medical documents leading to fraudulent payments totaling KSh2,032,680 by SHA.

Investigators allege that Patrick Kanya and Faith Chepkirui caused SHA to pay KSh30,000 by falsely claiming that a patient, Mary Njeri Njoroge, had undergone a cesarean section at Jambo Jipya Medical Clinic, when she had in fact delivered normally.

Other accused persons are linked to forged inpatient records and clinical notes for patients identified as Agnes Chisinde and Lucas Mwamba. Prosecutors claim that Steven Ojwang and Justine Baraka forged clinical notes, Pauline Wanjiru falsified a cardex, while Naida Mbevu uttered the falsified claim forms to SHA as genuine.

The matter will be mentioned on October 21, 2025, for further directions.
