Six individuals accused in a robbery with violence case connected to the 2015 killing of former Kabete MP George Muchai have been convicted after a court determined that the prosecution had proven its case.
In a judgment delivered at the Milimani Law Courts, the court ruled that evidence presented during the trial sufficiently linked several of the accused to a string of violent robberies, including the attack that led to Muchai’s death.
The court found the first, second, third and fourth accused persons guilty on multiple counts of robbery with violence and convicted them accordingly.
Trial magistrate Lukas Onyina stated that the prosecution had proved the charges beyond reasonable doubt, relying on the testimony of victims and other evidence presented in court.
According to the ruling, the first accused was identified as the suspect carrying a large firearm during the robberies. Witnesses consistently testified that the attacks were carried out by four men who were unknown to the victims before the incidents.
The magistrate further noted that the accounts given by victims in the different robbery incidents were consistent, particularly regarding the number of attackers and how the robberies were executed.
Several of the accused were also convicted on additional counts tied to other robbery incidents connected to the case. However, one of the suspects was acquitted after the court found the evidence against him insufficient.
In the ruling, the magistrate said the seventh accused had effectively exonerated himself through his testimony, and the prosecution failed to place him at the crime scenes. The court also observed that none of the witnesses reported seeing a woman among the attackers during the robberies.
Consequently, the seventh accused was acquitted and ordered to be released.
The court emphasized that while identification evidence formed part of the case, there was also other supporting evidence linking some of the accused to the robberies.
The case arises from a 2015 robbery attack in Nairobi in which Muchai and members of his security team were fatally shot.
Sentencing for the six convicted persons will be on April, 2026.
