An activist has moved to court seeking to compel court to order EACC to investigate Westlands MP Tim Wanyonyi for misappropriation of Sh 32 million bursary funds.

In a petition filed at the Milimani law courts, Francis Awino also wants Wanyonyi to be prosecuted for alleged crime.

According to court documents, the lawmaker misappropriated Sh 17 million and Sh 15.4 million in respect of bursaries to secondary schools and tertiary institutions as there was no documentary evidence including applications, approval process, acknowledgement by schools and institutions and a list of beneficiaries.

Awino says that there was illegal and irregular use of the National Government Constituency Development Fund (NG-CDF) for wetlands constituency for the year ending 2020.

He further claims that a review of the project implementation status report presented for audit revealed that Hospital Hill Primary School had received the Sh 5.5 million for the construction of a library with a capacity of 200 pupils.

He says the funds were deposited at the schools westlands main bank account from where payments were made.

He claims that a donor came on board and finalized the project but the unutilized funds have never been reallocated and the validity and completeness of transfers of the Sh 5.5 million could not be confirmed.

He also wants the court to stop Wanyonyi from taking any further management of the National government constituency development fund for Westlands constituency
