The state alleged that on July 12 the three and with other not before court, mobilised and incited the public to commit subversive activities by demonstrating

They denied the charges before Milimani Chief Magistrate Lucas Onyina and pleaded with the court to release them on reasonable bail terms.

LSK president Eric Theuri pleaded with the court to release them on bail saying that the accused were all state officers.

He urged court to grant them free bond further adding that the three being state officers will not jump bail.

The court also heard that Oluoch was unwell with his lawyer Peter Kaluma telling court that he suffers from hypertension.

Kaluma also alleged that his client was tortured while he was in the cells after his arrest.

In his submissions to court Theuri also questioned the recent upsurge of illegal arrest of leaders allied to Azimio saying the arrests are shameful as most leaders already have anticipatory bail.

He asked the trial court to direct then police to stop arresting people who already had anticipatory bail adding that the leaders can report to police with their lawyers.

“It’s a tragedy that an MP can be brought to court and charged with a kind of this charge, I’m worried..how many people will be charged for holding a different opinion,” There said.

Oluoch and Imwatok were released on a sh 100,000 cash bail while Orlando was released on sh 70,000 cash bail.

The case will be mentioned on 7th August for pre-trial.
