Baby Mama’ in Muthama Paternity Dispute Charged with Forging Birth Certificate

Nina Maria Wanjiku, a woman linked to former Machakos Senator Johnson Muthama in an ongoing paternity and matrimonial dispute, has been charged with forgery before the Milimani Law Courts.

According to the prosecution, Wanjiku is accused of presenting a forged birth certificate No. 300868 at the Nairobi Immigration Office on May 21, 1998. The certificate was allegedly falsified and claimed to have been issued by the Civil Registrar of Births in Thika.

Her legal team argues that the criminal case is rooted in a matrimonial property dispute currently before the High Court, implying that the criminal proceedings are being used to exert pressure.

While addressing the court, Wanjiku expressed frustration with the police, stating that she has been forced to record multiple statements over the same matter. She told Magistrate Ben Mark Ekhubi that the complainant is misusing the justice system to harass her.

Wanjiku further revealed the emotional and financial toll the case has taken on her, explaining that she resides in Mtwapa, Mombasa, yet has repeatedly been summoned to Nairobi over 800 kilometers away. She also recounted that during her arrest, she was forcibly taken to Nairobi along with her seven-year-old grandson.

In addition to the forgery charge, Wanjiku faces a second count of uttering a false document, contrary to Section 353 of the Penal Code. This offence involves knowingly presenting a false document with the intent to deceive and carries serious legal consequences.

Former Senator Johnson Muthama has been listed as the first prosecution witness in the case.

Wanjiku was released on a cash bail of Ksh 50,000 with two contact persons.

The matter is scheduled for mention on August 4, 2025, for pre-trial directions.
