A man has been charged at the Milimani Law Courts with conspiracy to defraud over a parcel of land in Nairobi’s Runda area.
Gideon Yator Cosmas Chebii appeared before Milimani Magistrate Joan Mati on Thursday, October 22, 2026, facing three charges relating to the disputed property. Chebii was charged with conspiracy to defraud contrary to Section 317 of the Penal Code, intermeddling with the property of a deceased person contrary to Section 45(2) of the Law of Succession Act and forgery of a judicial document contrary to Section 351 of the Penal Code.
He is accused of conspiring with others to defraud the estate of the late Magdalene Chepchirchir Bargetuny of a parcel of land known as LR 7785/805, now Nairobi Block 196/759, situated in Runda, Nairobi County.
He also faces an allegation of unlawfully taking possession of the parcel without lawful authority, jointly with others, and allegedly intermeddling with the deceased’s property. The third count alleges that Chebii forged a judicial document, namely a Power of Attorney purportedly issued by a Kenyan court, with intent to defraud.
Chebii denied all the charges against him. His defence counsel asked the court to consider lenient and reasonable bond terms pending the hearing and determination of the case.
Magistrate Joan Mati allowed Chebii to be released on a bond of Sh400,000 or a cash bail of Sh200,000, with two contact persons. The court also directed him to provide a letter from the area chief to assist in confirming his place of residence.
The case will return to court on November 10, 2026, for pre-trial proceedings.
