Nakuru Town East MP David Gikaria, who has secured interim High Court orders suspending IEBC sanctions imposed over alleged remarks made during a political rally in Ol Kalou.

The High Court has issued interim orders suspending the enforcement of sanctions imposed by the Independent Electoral and Boundaries Commission (IEBC) against Nakuru Town East MP David Gikaria as he challenges the decision before the court.

Justice Wilfrida Musyoka certified the application as urgent, observing that the dispute relates to conduct during the ongoing Ol Kalou parliamentary by-election and comes at a critical period as preparations for the 2027 General Election gather pace.

In orders issued By the High Court at Milimani, the judge directed Gikaria to serve the IEBC and the Electoral Code of Conduct Enforcement Committee with the court documents within seven days. The respondents were also ordered to file and serve their responses once they are served.

The court further granted temporary orders staying the implementation of the committee’s decision issued on July 14, 2026, pending the hearing and determination of the case.

The matter is scheduled for mention on July 29, 2026, when the court will issue further directions on the hearing of the petition.

Through his lawyer, Adrian Kamotho, Gikaria is seeking to have the committee’s decision quashed, arguing that the disciplinary process violated his constitutional rights to fair administrative action and a fair hearing.

According to the application, the MP says the committee proceeded with the hearing despite being informed that he had been admitted to hospital and was medically unfit to attend the proceedings. He also claims he was not given adequate time to review and respond to a cyber investigation report that the committee relied upon in reaching its decision.

The Electoral Code of Conduct Enforcement Committee found Gikaria guilty of violating the Electoral Code of Conduct over remarks he allegedly made during a political rally in Ol Kalou.
