The High Court has paved the way for the attachment and sale of Bank of Baroda (Kenya) Limited’s movable assets after the lender was ordered to pay Infinity Industrial Park Limited nearly Sh3 billion.

A warrant issued by the Milimani High Court Commercial and Tax Division on Tuesday, September 15, 2026, lists Sh2,996,003,000 as the amount currently due to Infinity.

Moran Auctioneers has been authorised to seize movable property belonging to the bank if the amount, together with the costs of executing the warrant, is not paid.

The auctioneer may subsequently sell the attached assets through a public auction after complying with the applicable legal requirements.

The enforcement action arises from HCCOMM/E322/2024, a dispute between Infinity Industrial Park Limited and Bank of Baroda (Kenya) Limited.

It follows the formal sealing of a decree awarding Infinity Sh2.996 billion in special damages.

Justice Peter Mulwa entered judgment in favour of Infinity on September 1 after the company withdrew its other prayers, leaving the claim for special damages.

The latest development also comes weeks after the High Court rejected an application by Bank of Baroda seeking to overturn a default judgment entered against it.

Infinity had previously attempted to resolve its dispute with the bank through negotiations, including proposals aimed at restructuring its financial obligations and releasing part of its industrial property that had been offered as security.

The company says it proposed paying about Sh250 million in December 2025 in exchange for the release of approximately 10 acres from its roughly 200-acre property. It intended to use the proceeds from the transaction to reduce its indebtedness to the bank.

According to Infinity, the proposal was not accepted.

The company further told the court that potential investors had expressed interest in providing significant funds to help settle the outstanding debt.

Infinity says it subsequently requested a comprehensive settlement figure from the bank and sought consideration of a full-and-final settlement, including possible relief from penal interest and other associated charges.

Attempts to revive negotiations continued after the court’s July 31 ruling, with Infinity seeking a meeting with the bank on August 5.

The company maintains that those efforts did not yield a settlement.

The dispute has also expanded to proceedings concerning the appointment of joint administrators by the bank in August. Infinity has challenged the appointment and alleges that it was made maliciously, a position that remains contested in the ongoing case.

Meanwhile, Bank of Baroda has changed its legal representation, with Archer & Wilcock Advocates now on record following the withdrawal of Musyoka Murambi.

The warrant directs Moran Auctioneers to report back to court by October 15, 2026, detailing whether it successfully executed the attachment or explaining why execution was unsuccessful.

The attachment and sale of the bank’s assets could, however, be affected if the judgment or execution process is stayed or restrained by a subsequent court order.
