NAIROBI, July 8, 2025 High Court Judge Diana Kavenza has rejected a fresh application for bail by Sarah Wairimu, the prime suspect in the murder of Dutch businessman Tob Cohen, ruling that she will remain in custody until the conclusion of the trial.

“The accused shall remain in custody until the completion of the trial,” the court stated.

The judge cited new concerns raised by the prosecution, including witness tampering, after it emerged that Wairimu had intimidated a police officer in open court by saying “shame on you” three times. The court also referenced an OB number provided by the prosecution as evidence of attempts to interfere with witnesses.

Previously, Wairimu had been denied bail in February until two key witnesses testified. While that condition has now been met, the court found that subsequent incidents of threats and intimidation warranted continued detention.

The investigating officer told the court that Wairimu had threatened four witnesses and described her as a flight risk, noting that her current residence is unknown.

Meanwhile, the court has granted lawyers representing the late Cohen’s sister, Sarah Cohen, permission to visit the scene of the crime, under the supervision of the Spring Valley OCS and the investigating officer.

Justice Kavenza urged parties to consider whether the case can proceed during the upcoming court recess, citing the large number of witnesses involved.

The murder trial will proceed with Wairimu remaining in custody.
