Court Allows KMJA to Join magistrate Stellah Atambo Petition challenging her prosecution.

Nairobi, July 8, 2025 The High Court has allowed the Kenya Magistrates and Judges Association (KMJA) to join a petition filed by Thika Chief Magistrate Stellah Atambo against the Office of the Director of Public Prosecutions (ODPP), the Directorate of Criminal Investigations (DCI), and EACC that challenged her prosecution.

The matter came up for hearing before Justice Chacha Mwita at Milimani Law Courts for hearing of the application by the KMJA seeking to be enjoined in the case as interested parties.

KMJA’s application for joinder was granted, allowing the association to participate as an interested party in the constitutional petition.

The court directed the petitioner to respond to an application filed by the Ethics and Anti-Corruption Commission (EACC) within 14 days.

Following the petitioner’s response, the respondents and interested parties are to file their written submissions limited to five pages after which the petitioner will have an additional 14 days to reply with submissions not exceeding five pages.

The matter is scheduled for highlighting of submissions on October 7, 2025.

In the meantime, the court extended interim orders previously issued that halted the state agencies from arresting or prosecuting her pending hearing of the case she filed in court.
