The High Court has found businessman Abdullahi Mohamed Mohamud guilty of contempt of court for violating orders intended to protect the operations of Roshan Energies Limited at disputed premises.

Justice Peter Mulwa ruled that Mohamud had disobeyed directives issued on August 28, 2025, which barred him from accessing or interfering with the company’s activities at the property. The decision followed an application filed by Roshan Energies and plaintiffs Abdiaziz Ali Hassan and Abdifatah Mohamed through their lawyer, Cecil Miller.

The dispute concerns premises where the company was developing a petrol station and convenience store. The plaintiffs accused Mohamud of continuing to assert control over the property and disrupting the company’s operations despite the existing court orders.

In their application, they alleged that the interference involved the destruction of company property and confrontations with security personnel. Some security officers reportedly sustained injuries and required medical treatment. The applicants also informed the court that Mohamud had been charged at the Makadara Law Courts with conspiracy to commit a felony in connection with the alleged destruction of the company’s property.

Mohamud denied violating the court orders, arguing that he had complied with the directives. He maintained that his presence at the premises was intended to report alleged vandalism to the police and also claimed an ownership interest in the disputed property.

In determining the application, Justice Mulwa found that the court orders were clear and that Mohamud had been served with them. The judge stressed that anyone dissatisfied with a court order must challenge it through the appropriate legal channels rather than act contrary to its terms. The court concluded that the evidence demonstrated continued interference with the premises and the company’s operations, amounting to deliberate disobedience of lawful orders.

The plaintiffs had sought to have Mohamud committed to civil jail for six months. They also requested compensation for damaged property and medical expenses, alongside police intervention to protect the premises.

However, the court declined to award compensation for the alleged losses, ruling that the amounts claimed required specific proof. The plaintiffs were granted permission to pursue the compensation claims separately.

Justice Mulwa directed the Officer Commanding Station (OCS) at Embakasi Police Station to enforce compliance with the August 28, 2025 orders and provide security for the company’s personnel and property. The court further summoned Mohamud to appear and explain why he should not be committed to civil jail for contempt of court.
