The application filed by suspended Cricket Kenya treasurer Kalpesh Solanki challenging the illegal AGM held over the weekend will be heard on June 19 alongside the application by the board that got orders staying judgment that had reinstated him into office.

In the application,Solanki has accused the board of Illegally and unlawfully holding an AGM to elect a new treasurer even though the court did not allow them to do that.

While issuing directions this morning, Justice Antony Mrima has said both applications will now be heard together on June 19.

Solanki has also been granted leave to file a formal application asking for maintenance of status quo in the matter to avoid the scenario of the board replacing him before the application is heard.

In his application through lawyer Danstan Omari, Solanki has told court that the board did not disclose to court all material of the case that was before the tribunal which stopped his ouster.

The court had earlier on May 19 issued orders staying implementation of the execution of the decision of the Sports tribunal which had ordered that Solanki reinstated into office.

However, Cricket Kenya filed an appeal and got stay orders on the ruling but according to Solanki they went further to hold an AGM which was not the court’s direction.

“Notwithstanding the Directions of this Honourable Court staying the execution of the decision of the Sports Dispute Tribunal, the Appellants have gone ahead to schedule an SGM, for the 24th of May 2025, whose main agendas, to wit, agenda number 3 to agenda number 5, directly touch on the Applicant herein and his former office, yet his presence at the SGM ought to be dispensed with,” reads court papers.

He wants the resolutions arrived at the SGM be considered to be null, void and non- binding until the court substantively pronounces itself on the Application staying the decision of the Sports Tribunal.

Solanki says he learnt of the intended scheduled SGM, dated May 24 to take place at Ruaraka Sports Club, and among the set agendas are the ratification of his suspension, the auditing of the financial report for the year 2023-2024 financial year, during which duration he was still the treasure

“It is wrong and improper for the scheduled SGM to take place in my absence given that I have been wrongly implicated and the agenda sets out my role and person as a greater part of why the meeting is being convened, as per the annexed notice of the intended SGM,” Solanki argues.
