Court Allows Additional Witnesses To testify in Rex Masai Death Inquest

The Milimani Principal Magistrate's Court allowed the National Police Service and IPOA to call additional witnesses but declined an application to recall a witness for a third time.

Court Allows Additional Witnesses To testify in Rex Masai Death Inquest

The Milimani Principal Magistrate's Court has allowed eight additional witnesses to testify in the Rex Masai death inquest before the case proceeds to conclusion.

The inquest into the death of Rex Masai will continue after the Milimani Principal Magistrate’s Court allowed eight additional witnesses to testify, despite the Independent Policing Oversight Authority having already closed its case.

In a ruling delivered on Thursday, Milimani Principal Magistrate Geoffrey Onsaringo granted an application by the National Police Service seeking to call six additional witnesses and also permitted IPOA to present two more witnesses before the inquest is concluded.

However, the court rejected an application to recall witness Doris Mukiri Mugambi for a third time, holding that such a request would amount to an abuse of the court process. Magistrate Onsaringo ruled that the additional evidence sought by the parties was necessary for the just determination of the inquest. He directed that summons be issued to the witnesses to appear before the court on a date to be fixed.

The six witnesses include representatives from the Integrated Control and Communication Centre (IC3), Absa Bank, Makau Casino, Bliss Hospital and International Life House. The court also allowed officers from Kamukunji, Kilimani, Pangani and KICC police stations to testify and produce Arms Movement Registers. In addition, IPOA was granted leave to call two further witnesses.

The magistrate further ordered that no additional applications to recall witnesses would be entertained and that no further witnesses would be allowed unless exceptional circumstances are demonstrated and the court is satisfied that their evidence is necessary for the fair determination of the inquest. Principal Magistrate set 6th August, 2026 for a mention to set a date for hearing.
