A Police officer who sentenced to one year in jail for losing his firearm finished his sentenced months ago before the high court could hear his bail appeal.
Cleophus Otundo was convicted and sentenced to one year and he applied for bail pending appeal but his application was never heard until he finished his term.
Through his lawyer Danstan Omari, Otundo is now pushing for his appeal against the conviction and sentence issued by the lower court against him because the bail application has been passed by events.
Otundo was charged in 2016 with loss of a firearm and it was alleged that while serving as an officer at Kabete Police Station he lost his gun.
The court heard that Cleophas Otundo lost his gun between February 15 and 16, 2016 at unknown place in unclear circumstances that he could not explain.
Last year, Otundo was found guilty of the offence and sentenced to pay a fine of Sh 10,000 and serve a one-year jail term.
Otundo then filed an application for bail pending appeal and the application never really happened as it was pushed from time to time until he finished his one-year jail term.
The matter was mentioned today before Justice Lilian Mutende and Omari confirmed that they had filed and served their submissions.
The DPP was yet to file and serve their submissions and they told court that they were in the process of filing.
