DPP drops charges against Masimba GSU cops,recommends public inquest into the alleged shooting

Nine General Service Unit officers who were facing murder charges in relation to the Masimba shooting will not be charged.

This is after the DPP said he will not prefer any charges against the officers but instead he recommended a public inquest to ascertain who killed the four Masimba protestors.

The officers include their commander at the time Cornelio Tokoyi, John Njoroge, Zakayo Kurere, Hosea Chikar a, Mohammed Qalla, Kipkorir Wesley Sigisin, Adan Kassim and Wambua Kilonzo.

They had challenged their prosecution through lawyer Danstan Omari arguing that there were only discharging their mandate.

The application was filed last year and it has been pending in court with the DPP telling court on several occasions that they had not issued a decision to charge yet.

The case was mentioned in court Monday and the court heard the DPP had directed IPOA to withdraw the criminal case that had been filed against the cops.

Justice John Chigiti directed the matter to be mentioned on October 11 to allow time for the DPP to get a written confirmation of withdrawal of the case.

IPOA had recommended the prosecution of the officers to the DPP who approved the charges saying the GSU officers were culpable for the offence of murder due to the evidence on record.

However, through their lawyer Omari the officers said they were ambushed by over 1500 protesters as they were coming back from Nairobi and didn’t kill anyone.
