High Court Halts Vetting of Sossion, Lentoijoni as TSC Commissioners

Justice Joyce Mkambe Gandani issued a 21-day conservatory order barring Parliament from vetting or approving Wilson Sossion and Antonina Lentoijoni pending the hearing of a constitutional petition.

High Court Halts Vetting of Sossion, Lentoijoni as TSC Commissioners

The High Court has temporarily stopped the National Assembly from vetting and approving Wilson Sossion and Antonina Lentoijoni as TSC commissioners pending the hearing of a constitutional petition.

The High Court in Kerugoya has temporarily stopped the National Assembly from proceeding with the vetting and approval of Wilson Sossion and Antonina Lentoijoni as Commissioners of the Teachers Service Commission (TSC).

Justice Joyce Mkambe Gandani issued conservatory orders restraining Parliament, its committees, officers and agents from undertaking any step in the approval process pending the hearing and determination of a constitutional petition challenging the appointments.

The petition was filed by Kelvin Wafula, who is contesting the legality of the nomination process. The suit names the State Law Office, the Teachers Service Commission and three other respondents. After certifying the matter as urgent, Justice Gandani granted a 21-day conservatory order, effectively freezing the vetting process initiated through Notification of Presidential Action No. XI of 2026.

The two nominees had been proposed for appointment by President William Ruto, with the notification of their nomination issued by Chief of Staff and Head of Public Service Felix Koskei as part of efforts to fill vacancies in the TSC.

The court directed that the matter be heard inter partes on August 18, 2026, when parties will appear before the court for further directions and the application for conservatory orders will be considered.

Until then, the National Assembly cannot vet or approve the two nominees unless the court varies or lifts its orders.

Justice Gandani further cautioned that any individual or institution that disregards the conservatory orders would be liable to legal sanctions for disobeying court directives.
