IG Kanja, DCI Boss Amin Appear in Court to Heed Summons But Do Not Testify in Alleged Abduction Case

IG Douglas Kanja and DCI Director Mohamed Amin appeared before the High Court over the alleged disappearance of three men but did not testify, as Evans Otieno's mother told the court she has searched for her son without success.

Inspector General of Police Douglas Kanja and Directorate of Criminal Investigations (DCI) Director Mohamed Amin on Monday appeared before the High Court in Nairobi in compliance with summons issued in a habeas corpus application over the alleged disappearance of three men but did not testify.

The two senior security officials appeared before Justice Alexander Muteti after the court rejected the State’s request to have junior police officers appear on their behalf or rely solely on affidavits, insisting they personally attend court.

The case concerns the alleged abduction and disappearance of Macmilan Kiarie, Michael Oloo and Evans Otieno.

After confirming their attendance, Justice Muteti thanked both Kanja and Amin for honouring the court summons and excused them from further participation in the day’s proceedings. The judge directed that they would only be required to return if issues arose during the hearing requiring their personal responses.

The hearing then proceeded with evidence from the mother of Evans Otieno, who emotionally told the court she had searched for her son in police stations, hospitals and mortuaries without finding him. She testified that they visited Thika Level 5 Hospital, where they were shown nearly 50 unidentified bodies, but her son was not among them. She added that they later searched at Nairobi City Mortuary but still did not find him. The witness further told the court that her son has never been arrested and has no criminal case pending before any court.

Holding back tears, she pleaded with the court to help her locate her son.

The hearing of the habeas corpus application is ongoing.
