Senior counsel Martha Karua has taken a firm stand against the Directorate of Criminal Investigations (DCI), accusing the agency of blatantly disregarding court orders in the ongoing case involving missing blogger Ndiangui Kinyagia.
“There has been no compliance. They are not taking the orders of this court seriously,” Karua told the court. “It is their business to find him that’s why we pay them.”
Karua’s remarks came in response to the DCI’s continued failure to produce Ndiangui in court, despite mounting public pressure and active legal proceedings. She noted the case has attracted national attention, yet the DCI a key respondent has failed to provide clarity, choosing instead to issue a public denial at 4pm the previous day.
“He appears before the public to deny holding Ndiangui but can’t come to court and explain himself? That’s sub judice,” Karua submitted.
She also questioned the authenticity of a sworn affidavit filed by the DCI through Sgt. Samuel Itegi, raising the possibility that it may contain forged or misleading information. “We have noted several differences,” Karua told the court, detailing the inconsistencies.
Karua insisted that the state bears full responsibility for the disappearance of Ndiangui. “Produce Ndiangui. That’s your job. That’s why we pay you,” she said.
